J, an immigrant from Mauritania, works part time for two Philadelphia employers. He also needed a knee replacement. When J’s surgeon told him to bring in any forms so he could claim disability, J assumed that meant there was a disability program in the US that applied to him. After his surgery, he came to the MLCP at HC#3 because they had assisted in getting him on Medicaid and asked for help with getting these forms.
With the help of Philadelphia Legal Assistance, J called each employer and found out that they did not offer disability for their part time workers. His 2-month recovery time was too short to qualify for SSD or SSI, but because of Philadelphia’s sick time policy, he did have that option.
His employers claimed to be unaware of the new sick time law, but they agreed to give him the time he earned when they received more information about it. J was eligible for about a week of pay. It did not cover his entire absence, but it helped.

Paid Sick Days Access and Usage Rates Vary by Race/Ethnicity, Occupation, and Earnings

Analysis by the Institute for Women's Policy Research (IWPR) finds that four in ten workers in the United States lack access to paid sick days, and among those who do have access, only 55 percent of workers actually used any sick days in the previous year. Inequality in access to paid sick days exists within and across occupations, with supervisors more likely to have paid sick days than non-supervisors. Hispanic, low-wage, and food service and personal care workers are least likely to have access to this important benefit.

Earned Sick Days At Work: Passing the 10 MILLION Mark!

And just how many people are now covered, you ask? More than 10,400,000 workers now have access to earned sick days nationwide.
The national effort to secure rights for workers and their families have ensured a higher standard of living for many men, women, and children. But our job is far from over! Paid Sick Leave for Preventive Health Care and Healthy Lives

Since the Affordable Care Act (ACA) took effect in 2010, health care access has opened up to numerous Americans, including low-income earners who were previously uninsured and women seeking preventive care. Unfortunately, too many Americans simply do not have the time to actually receive these services.
More than 40 million workers in the U.S. (39 percent) have no paid sick days and nearly 95 million workers (87 percent) have no paid family leave. 80 percent of low-wage workers earning $15,000 or less per year have no paid sick days.
Work protections such as paid sick leave and paid family and medical leave are crucial for preventive health care, which in turn is key for healthy and safe lives. Routine health checkups and screenings can help prevent or detect early on diseases and other health problems, but a 2015 study found that women without paid sick leave were 12 percent less likely to undergo breast cancer screening than women with paid sick leave.
A similar trend was found with attention to prenatal care. Additionally, about half of Americans who qualify for unpaid job protected leave under the Family and Medical Leave Act (FMLA) defer or choose to forgo care altogether because the financial cost of taking unpaid time off is too great.
21 jurisdictions have now passed earned sick days laws, but the need for such minimum standards continues.

New Poll Shows Voters Want Economic Security, Including Earned Sick Days
A new national poll sampling 1,200 voters from last week's election shows that paid sick days wins in Massachusetts, Oakland, Montclair, and Trenton represent the public's desire for workplace policies that create economic security.
This poll showed that 81% of voters say it is important for lawmakers to consider policies like paid sick days and paid family/medical leave. Here's more on the poll from our friends at the National Partnership for Women & Families:

- Strong support for family friendly policies across party and demographic lines: 96 percent of Democrats, 74 percent of independents, 73 percent of Republicans, 87 percent of women, 75 percent of men, 95 percent of voters under 30, 97 percent of African Americans and 95 percent of Latinos said it is important for lawmakers to consider new family friendly workplace laws.
- Widespread concerns about serious medical or caregiving needs resulting in financial hardship: An overwhelming majority of voters, across demographic and party lines, said they or their families would likely face significant financial hardship if they had a serious illness, had to care for a family member with a serious illness, or had a new child: 66 percent said it is likely, and more than one-third (36 percent) said it is “very likely.”
- Approval of candidates who express support for policies that promote families’ economic security: Nearly two-thirds of voters (64 percent) said that an elected official’s support for equal pay for women, paid sick days, and paid family and medical leave would make them more likely to vote for that elected official, including nearly half (46 percent) who said they would be much more likely to cast a favorable vote.
The poll of 2014 voters was commissioned by the National Partnership for Women & Families and the Rockefeller Family Fund.

Two Quick Updates on Paid Sick Days Across the Country
- A survey conducted by the Public Religion Research Institute shows that 78% of Americans favor requiring companies to offer paid family leave for childbirth or adoption. The same study shows that 81% of Americans favor requiring companies to offer paid sick days to full-time employees to use when the employees or their immediate family members are ill.
- A Better Balance has published an updated list of cities and states with earned sick time laws.

City Council to Introduce Resolution to Study Paid Sick Days for All Workers
Philadelphia City Councilman Bill Greenlee will be introducing a resolution on Thursday, September 12,
asking the city to study the economic opportunities available to women in Philadelphia.
This resolution is part of ongoing work with elected officials ways to grow the middle class and the economy, including family leave, extending FMLA to siblings, affordable childcare, earned sick days, and equal pay as ways.

Americans Get Fewer Paid Sick Days Than Two Decades Ago
For workers who are fortunate enough to get paid sick days at all, are now getting fewer days from their employers than previous years. While workers are reporting more vacation days in 2012 compared to 1992-1993, the overall number of days available is fewer.
Of course, many workers still don’t have any access to paid sick leave at all: About 40 percent of private sector workers can’t take a paid day off to care for themselves or a family member when illness strikes, including 80 percent of low-income workers.
Cities and states across the country are trying to address this issue, and some have succeeded. New York City, Seattle, San Francisco, Washington D.C, Portland, and the state of Connecticut all have laws that require most employees to receive a minimum amount of paid sick days per year.
Efforts in Philadelphia and the states of Massachusetts and New Jersey, among others, are ongoing.

Since New York City overrode Mayor Michael Bloomburg's veto to pass earned sick days, more reporters have been covering the topic. Here is some of the latest news:
- For Millions of Workers, Getting Sick Doesn't Pay - "due to the absence of a national policy and because the choice to provide sick leave is mostly left to businesses, an estimated 38 percent of U.S. workers, or almost 40 million, lack any paid sick leave, according to the Center for American Progress."
- Paid Sick Leave Laws Generate Concern, but Not Much Pain - "Six years later, Mr. Stone admits to having been a little alarmist about paid sick leave. “As a small restaurant business, it’s really hard to make money, and when they add another requirement, it makes you nervous,” Mr. Stone said in a recent interview. “But all and all, I actually think it’s a good thing.” "
- Policies to Reduce Influenza in the Workplace: Impact Assessments Using an Agent-Based Model - Conclusions. PSDs reduce influenza transmission owing to presenteeism and, hence, the burden of influenza illness in workplaces.

NutterWatch: 6 Days to Keep the Rivalry with New York Going For Philadelphians
On March 14, 2013, Philadelphia City Council passed a bill providing the opportunity for most workers in the city of Philadelphia to earn paid sick days. Mayor Michael Nutter has until April 4, 2013, to sign the bill into law or to let it leave his desk unsigned.
Either choice will pave the way for nearly 200,000 workers in Philadelphia to have access to earned sick days for the first time.

Let me start by saying that all of us in Philadelphia are incredibly proud of the folks in New York City who have finally made earned sick days a reality for their workers. It took a lot of hard work and a lot of compromise, but in 2014, workers in NYC will be able to earn the time they need to care for the families they love.
That being said, there are few rivalries as cherished in Philadelphia as the ones we have with New York. When the Phillies play the Mets, we pack our stadium (and when it is in NYC, we pack theirs). We love to hate the Yankees, the Giants, the Rangers. When we re-signed Cliff Lee, it was incredible - and the signing was made more incredible by the story that he turned down more money from the Yankees to come here.
So are Philadelphians going to let New York City pass an earned sick days bill without Mayor Nutter signing our bill into law? That doesn't sound like the Philadelphia I know and love. If you agree, please take a minute to sign our petition asking Mayor Nutter to make earned sick days a law in Philadelphia.
All kidding aside, congratulations to New York. And Portland, Seattle, Connecticut, Washington D.C., and San Francisco. We can't wait to officially join the list.
