The Coalition for Healthy Families and Workplaces is thrilled to announce that the <a href="https://pittsburgh.cbslocal.com/2019/07/17/pittsburghs-paid-sick-leave-law-stands/" target="_blank">Pennsylvania Supreme Court released a decision</a> July 17, 2019, to uphold Pittsburgh's 2015 paid sick days law. 49,000 workers now have access to paid sick days in Pittsburgh.<br />

From passage of the initial law to final arguments in the Supreme Court, many Coalition members played important roles over the past four years. This year, there’s a real prospect that Congress will take up the federal paid leave bill - the Family and Medical Insurance Leave Act (FAMILY Act). FAMILY is expected to be introduced in February, and to bolster its chances, we’re trying to get as many sponsors as possible by the introduction date. We need your help to reach Congress.<br />
<br />
We need the FAMILY Act because we need a program that reaches all of us. Newborn or newly adopted children need time to bond with their parents, but those who aren't parents still have parents or partners or other loved ones who occasionally need care. At some point, each of us will likely require time to heal. And those who deploy to the military may need help meeting their family responsibilities. The FAMILY Act covers all these situations. We know that members will be offering some amendments to make it even more effective in reaching those who have the least access to paid leave.<br />
<br />
It has been truly amazing to stand with you over the years in our collective fight for working families in Pennsylvania. Let's continue working to make paid family leave a reality.<br />

Many small employers would love to offer paid leave but can't afford to do so on their own - that's why the majority of small businesses surveyed support the FAMILY Act.</li>

On June 14th, Councilwoman Gym, along with 7 co-sponsors, introduced a <a href="https://twitter.com/fairworkweekphl?lang=en" target="_blank">Fair Workweek</a> bill for Philadelphia. The bill would require that the city's largest employers of food service, retail and hospitality workers provide at least two weeks' advance notice of their schedules. In addition, it would create financial disincentives for employers to keep using the practices of clopening*, and mandatory on-call time, for these workers.<br />

Before the bill can be voted on in Council, it has to have a hearing in the Law and Government Committee. <a href="https://actionnetwork.org/events/fwwhearing" target="_blank">That hearing has now been scheduled for Tuesday, Oct. 30th at 2 pm in City Council Chambers.</a><br />

<br />
Since 2013, Pennsylvania’s lawmakers have introduced and moved numerous pieces of legislation that would allow them to interfere with paid leave laws. The Coalition for Healthy Families and Workplaces and their members stopped each bill so far. However, the latest attempt, HB 861, would take away not just Philadelphia’s law but many other local measures protecting workers from wage theft, gender discrimination, and unequal pay. <br />
<br />
This practice of state interference, also known as preemption, pops up again and again across the country. The <a href="https://www.nlc.org/sites/default/files/2017-03/NLC-SML%20Preemption%20Report%202017-pages.pdf" target="_blank">National League of Cities 2018 preemption report</a> lists 162 preemption laws that have passed nationwide - <a href="https://www.nlc.org/article/state-preemption-of-local-authority-continues-to-rise-according-to-new-data-from-the" target="_blank">including 19 laws created in 2017</a>. These laws invalidate local democracy in favor of corporate interests who feel they can oppose laws more easily in 50 state capitols than they can in local governments nationwide.<br />
<br />
Our network in Pennsylvania could use your help ensuring that local laws remain in place to protect the people who support them. Paid sick and safe days, wage equity, and gender nondiscrimination create a more equitable workplace for everyone, especially women, people of color, and the LGBT community. Here's what you can do:<br />

<li>[UPDATED 10/2/18] - On October 1, <a href="http://www.legis.state.pa.us/cfdocs/billInfo/billInfo.cfm?sYear=2017&sInd=0&body=H&type=B&bn=2071" target="_blank">HB 2071</a>, which allows employers to opt out of certain local labor laws at their discretion, came out of committee and was immediately voted on and sent to the Senate. While this law was written in response to a Philadelphia ordinance regarding bulletproof glass, it is written in vague enough terms that it might be used to apply to other workplace laws. Please call your Senators and ask them to oppose this bill.</li>

Pennsylvania - New public opinion survey results from Pennsylvania released today show strong voter support for new national policies that support working families, echoing national trends.<br />
<br />
"The breadth of support is welcome but not surprising news," said Marianne Bellesorte, Vice President of Advocacy at PathWays PA. "Access to paid family leave helps spur our economy while keeping families safe. Financial protection for working families, whether they have a new baby or a new cancer diagnosis, is long overdue."<br />
<br />
Sixty percent of surveyed Pennsylvanians said it is likely that they would face significant economic hardship if they had to take time from their job to deal with a serious illness, to care for a new child or to care for a family member with a serious illness. Sixty-eight percent strongly or somewhat support a proposed law guaranteeing that working people in the U.S. can earn up to seven paid sick days each year from their employer to use if they or a family member has a routine illness like the flu or needs to see a doctor.<br />
<br />
By a nearly two-to-one margin, 61 percent of voters in the 15 states that were polled support the creation of a national paid family and medical leave fund, 69 percent support a paid sick days law and 57 percent support increasing access to high-quality affordable child care.<br />
<br />
Commissioned by the 15 national organizations that make up the Work Family Strategy Council, these new results provide further evidence of the strong public demand for policies that help people manage family and work responsibilities.<br />
<br />
Surveys were conducted among 9,611 registered voters between July 7-10 in Arizona, Colorado, Florida, Georgia, Iowa, Minnesota, Nevada, New Hampshire, North Carolina, Ohio, Oregon, Pennsylvania, Virginia, Washington and Wisconsin and the results were aggregated and averaged across the states. Key findings from the aggregated data include:<br />
<br />
<ul>
<li>Voters across states say they favor a law that would create a national paid family and medical leave fund: 61 percent say they favor such a law, 44 percent say they strongly favor one, and only 34 percent express any opposition.</li>
<li>Support for paid family and medical leave spans political parties: 84 percent of Democrats, 50 percent of Independents and 42 percent of Republicans say they favor a national paid family and medical leave fund.</li>
<li>A strong majority of people surveyed say they face challenges when managing job, family and personal responsibilities: 63 percent of full-time workers and 67 percent of part-time workers say they would be likely to face significant economic hardship if they had to take time off without pay to care for a new child, care for a seriously ill loved one, or deal with their own serious health issue.</li>
<li>Voters in all 15 states say they would be more likely to vote for an elected official or candidate who supports creating a paid family and medical leave fund.</li>
<li>Voters also strongly support establishing a national paid sick days standard and increased access to high-quality, affordable child care: 69 percent say they favor a law that would guarantee all workers the right to earn paid sick days from their employers; only 28 percent express opposition. Additionally, 57 percent say they favor increased access to high-quality, affordable child care; 35 percent express opposition.</li>

"Our nation prides itself on having strong family values, yet we are the only developed nation in the world without paid family leave. The polling data confirms Americans want the ability to take care of their families while remaining in the workforce. Family Leave Insurance Funds provide a way for workers to care for their families while keeping our economy on track," said Heather Arnet, CEO of the Women and Girls Foundation located in Southwest Pennsylvania.<br />

"Of course there's broad support for paid leave," said Terry L. Fromson, Managing Attorney of the Women's Law Project. "Paid leave benefits both families and employers. People need to be able to care for babies and sick family members without being pushed out of the workforce, which is, unfortunately, what happens to women in particular."<br />
<br />
Despite the nearly universal challenges people face trying to balance the demands of job and family, only 12 percent of private sector workers in the United States have access to paid family leave through their employers, and only 61 percent have access to paid sick days. For lower-wage workers, access to paid time off to use for family and medical needs is even rarer. The new data suggest voters strongly favor changing these realities.<br />

"It would have meant everything to have paid family leave, or for my husband to have it now," said Jessica Karabian, a Southampton, PA, mother with stage IV cancer. "We wouldn't have to worry so much about cutting things for our daughter. Eloise is 3, but she can't go to preschool because we have to pay medical bills. I just don't you think you should have to go bankrupt because you're sick."<br />

It came out of nowhere. I have no family history, I don’t have the BRCA gene. But, at age 29, I had an eight month old baby - and stage II breast cancer. <br />
<br />
Over the next six months, I took FMLA and (unpaid) administrative leave from my work so I could juggle treatment and motherhood. After six rounds of chemo, a bilateral mastectomy, and 6 weeks of radiation treatment, I returned to work – only to learn three months later that the cancer had spread to my bones. My company said I needed to wait at least another three months to be able to use FMLA again, but that was time I didn’t have. After going back on administrative leave, I was later forced to terminate my employment.<br />
<br />
I’m coming up now on my two years since my second diagnosis. My cancer has stayed in my bones, which is good, but with Stage IV cancer, treatment is always changing. I’m at the hospital for chemo every three weeks, plus scans, plus doctor’s appointments – it’s been impossible to go back to work. I get Social Security, but it is not nearly what I was making before. My husband works, but living on one income is almost impossible in this country. And he doesn’t get any paid sick days, so it’s very hard for him to take time to help me when I am sick.<br />
<br />
Being younger and having this happen to you – we never had a chance to build up a savings account or 401K. We were planning to buy a house, and we had to use all those savings for medical bills. Sometimes it feels like we are totally scrambling and losing everything because of something I couldn’t control. <br />
<br />
It would have meant everything to have paid family leave, or for my husband to have it now. We wouldn’t have to worry so much about cutting things for our daughter. Eloise is 3, but she can’t go to preschool because we have to pay medical bills. If my job had paid family leave, maybe I wouldn’t have had to choose between treatment and my job. I wanted to find a way to continue to work. Even if I had paid family leave just that first time I was diagnosed, maybe we would have had enough money to buy a house. We could have had child care. Our savings could still be intact.<br />
<br />
People ask me all the time “Well, don’t you have insurance?” They don’t realize that you’re still paying out of pocket for lots of tests, lots of treatment, and a lot of your time is spent out of work and in doctor’s offices. Insurance is great, but it can only take you so far. I want to work, not to be on disability. I want to have the option of maintaining a normal life while living with chronic – yes, eventually it will be terminal, but so far it’s been chronic – illness. I would love to continue to work because my family would be in a much different financial situation and I had a really good job. <br />

J, an immigrant from Mauritania, works part time for two Philadelphia employers. He also needed a knee replacement. When J’s surgeon told him to bring in any forms so he could claim disability, J assumed that meant there was a disability program in the US that applied to him. After his surgery, he came to the MLCP at HC#3 because they had assisted in getting him on Medicaid and asked for help with getting these forms. <br />
<br />
With the help of Philadelphia Legal Assistance, J called each employer and found out that they did not offer disability for their part time workers. His 2-month recovery time was too short to qualify for SSD or SSI, but because of Philadelphia’s sick time policy, he did have that option. <br />
<br />
His employers claimed to be unaware of the new sick time law, but they agreed to give him the time he earned when they received more information about it. J was eligible for about a week of pay. It did not cover his entire absence, but it helped.<br />

A new report from the Main Street Alliance surveyed over 1000 businesses from 9 states to get their feedback on a variety of public policies. Among other findings, a majority of businesses supported a federal paid family leave policy and a national earned sick days policy.</div>

JOB QUALITY and WORKPLACE ISSUES<br /><ul>
<li>Paid family leave. While a majority don’t currently offer paid family leave, most small business owners surveyed support a national paid family and medical leave program.</li>
<li>Earned paid sick days. While just over half don’t currently offer earned paid sick days to their employees, a majority of small business owners surveyed support a national earned paid sick days policy, like the Healthy Families Act.</li>
<li>Raising the minimum wage. An overwhelming majority believe that anyone working full-time deserves to be out of poverty.</li>

Last month, the Department of Labor released a report on what it costs to <u>not</u> pass paid leave policies in the United States. Currently, only 12% of workers have access to paid parental and family leave, and about four in ten get paid medical leave through short term disability. For new and adoptive parents, people dealing with a life-threatening diagnosis, or people involved in accidents, the lack of long term paid leave is devastating to their pockets and to their lives.<br />
<br />
Here are some of the findings:<br />
<br />
Children have better health outcomes when their parents have paid leave:<br />
<br />
<ul>
<li>Increased birth weight, decreased premature births, and decreased infant mortality are all associated with access to maternity leave.</li>
<ul>
<li>Mothers who choose and are able to breastfeed and have maternity leave tend to have better breastfeeding outcomes.</li>
</ul>
<li>Children with serious or chronic illness have better physical and emotional health outcomes when their parents have access to fully paid leave. Parents also report that their emotional health is better and they have a decreased likelihood of financial problems during that time.</li>
<li>Fathers who take two weeks or more of parental leave are more likely to be actively involved in their child's care nine months after birth - including getting up in the night with a child, feeding, and changing diapers.</li>
</ul>

Businesses save money through paid leave policies:</div>
<div>
<ul>
<li>Paid maternity leave in particular and paid leave in general reduces turnover costs and increases retention, saving businesses the money spent on replacing valuable members of their team.</li>
<li>Offering paid leave makes it easier for companies to compete for talent internationally.</li>
</ul>
<div>
Our economy is better off with paid leave policies:</div>
</div>
<div>
<ul>
<li>Paid maternity leave increases female participation in the labor force, which in turn supports economic growth for our country. DOL estimates indicate that if women aged 25-54 participated in the labor force at the same rate as Canada or Germany (which offer family policies including paid leave), 5 million more women would be in the labor force, generating $500 billion more economic activity each year.</li>
</ul>
</div>
Families are financially better off with paid leave policies:<br />
<br />
<ul>
<li>60% of workers without fully paid leave put off bills, used savings, and/or cut their leave short to make ends meet.</li>
<ul>
<li>84% of workers with unpaid/partially paid leave put off spending, which hurts their families and our economy.</li>
</ul>
<li>Mothers with access to paid leave are more likely to be employed following childbirth, In fact, access to paid leave policies can increase the number of hours worked. Work benefits a family in the short-term, of course, but it also gives women more of a safety net in retirement thanks to increased savings and more time under Social Security.</li>
<ul>
<li>Paid maternity leave is associated with increased pay for women with children, which helps close the pay gap.</li>
</ul>
<li>Women who have and use paid parental leave are 39% less likely to receive public assistance in the year following childbirth.</li>
</ul>
<div>
Finally, some of the cost of doing nothing can't be measured in numbers. As the report points out, women are being sidelined in business while men are denied opportunities at home. </div>

As workers across the country celebrated Labor Day yesterday, President Obama issued a new executive order to add even more joy to the festivities. Under his instructions, more than 300,000 federal contractors who do not currently have paid sick days will be able to earn sick time to care for themselves and their family members.
